Superficie Conveniente, Lda., hereinafter referred to as "ATLANDY", is the company responsible for data processing in Portugal. ATLANDY values the privacy of its users and is committed to protecting their personal data, ensuring transparency and security in its processing.

This document describes how we collect, use and protect personal data, as well as the rights of data subjects, in accordance with the General Data Protection Regulation (Regulation (EU) 2016/679 - "GDPR") and Law No. 58/2019 of 8 August.

Categories of processed data: name, address, email, telephone, tax identification number (NIF), payment details, browsing data (cookies).


3. Legal Basis

The processing of personal data is based on:

  • Performance of a contract or pre-contractual measures (Art. 6(1)(b) GDPR).
  • Compliance with a legal obligation (Art. 6(1)(c) GDPR).
  • Explicit consent of the data subject (Art. 6(1)(a) GDPR), when applicable (e.g. marketing or non-essential cookies).
  • Legitimate interest of ATLANDY, provided that such interest does not override the rights and freedoms of the data subject (Art. 6(1)(f) GDPR).

4. Data Sharing with Third Parties

Personal data may be shared with:

  • Subcontractors providing services to ATLANDY (e.g. couriers, IT providers, payment services), strictly for the contractual purposes defined and under a confidentiality obligation.
  • Public authorities, when required by law.
  • Cloud or technology services located outside the European Economic Area (EEA): if an international data transfer occurs, ATLANDY ensures that it takes place only under a European Commission adequacy decision or Standard Contractual Clauses approved by the European Commission.

5. Data Retention Periods

Data will be retained only for the period strictly necessary for the purposes mentioned above:

  • Contractual and invoicing data: up to 10 years (legal requirement).
  • Customer data: for the duration of the contractual relationship or until the exercise of the right to object or erasure.
  • Marketing data: until consent is withdrawn.
  • Cookies: as defined in the Cookies Policy.

6. Rights of Data Subjects

Data subjects may exercise their rights at any time, namely:

  • Access: to know which data are being processed.
  • Rectification: to correct inaccurate or incomplete data.
  • Erasure: to request the "right to be forgotten".

2. Liability

Atlandy's liability with respect to any product purchased through the website is limited.

Atlandy is not responsible for the accuracy or currency of the information concerning the characteristics of products available for purchase in the online shop, as it merely reproduces data provided by its partners.

Atlandy shall not be held liable for damages suffered by third parties resulting from the use of purchased products, nor for consequences arising from their improper use.

User Account

If the user utilises any Atlandy Service, they are responsible for maintaining the confidentiality of their account and password, as well as for restricting access to their computers and other applicable electronic devices.

The user also assumes responsibility for all activities conducted using their account password.

Atlandy Services are not intended for minors.

If the user is under 18 years of age, they may only use Atlandy Services under the supervision of a parent or legal guardian.

Atlandy reserves the right to refuse service, cancel accounts, or remove or modify content at its sole discretion.


User Licence

By submitting material, and unless otherwise indicated, the user grants Atlandy a non-exclusive, royalty-free, irrevocable, and fully transferable licence to third parties to use, reproduce, modify, adapt, publicly communicate, translate, create derivative works from, distribute, and display such content worldwide, through any medium, for as long as the user is legally entitled to grant such licence.

The user grants Atlandy and its sublicensees the right to use the name submitted in connection with such content, if they so choose.

3. Promotions and Sales

3.1 Definitions

Promotions are understood as sales carried out with the purpose of boosting the marketing of certain products or launching a product not yet marketed by Atlandy, offered at a price lower than the lowest price previously applied, or under conditions more advantageous than those used during non-discounted sales periods.

In the case of a product not previously marketed, it may be sold under promotion at a price lower than that which will be applied after the promotional period or under conditions more advantageous than those that may subsequently apply.

Promotions may take place at any time deemed appropriate by Atlandy, always in compliance with the applicable legislation.

Sales (Clearance Sales) are understood as the sale of products at a price lower than the lowest price previously practised in the same commercial establishment, with the purpose of promoting the accelerated disposal of existing stock.

The holding of sales is subject to the adoption of the applicable legal procedures, which Atlandy will strictly comply with.

Section 2: Specific Terms and Conditions

1. Scope of These Specific Terms and Conditions

These Terms and Conditions apply to all proposals and contracts relating to the sale and delivery of products by Atlandy. Any deviation from these Purchase Terms is only possible by written agreement authorised by Atlandy.

Here you can find all pre-contractual information relating to distance contracts, as required by Article 4 of Decree-Law No. 24/2014, of 14 February.

If the User is considered a consumer for the purposes of that legislation, the respective legal framework shall apply.

Atlandy reserves the right to freely modify the pre-contractual information in order to adapt it to applicable legislation, without prior notice.

Browsing the website and purchasing any product through the online shop imply the full acceptance of this information and the General Terms and Conditions of Use.

If the User does not agree with them, they must refrain from browsing the website or making any purchase. By proceeding, the User expressly declares full acceptance thereof.

Whenever there is suspicion that a purchase is false and/or fraudulent, Atlandy may immediately, and without prior notice, cancel and annul the order, and may also report the occurrence to the competent authorities.

Important Note: The information contained on the website constitutes only an invitation to contract. The contract is only deemed concluded after the completion of the contractual process and subsequent acceptance by Atlandy.

Online sales are only valid and applicable when the product in question is available for the customer's country. There may be products available for certain countries and not for others. The customer should always confirm the product's availability in their country before making a purchase.


5. Placing Orders through the Online Shop

To place your first order, simply select the desired product(s) and follow the steps until payment. Once payment is completed, your purchase will be finalised.

During this process, you may also register on our website quickly and easily by filling in the required form with your details.

At the end of your first purchase, your account will be automatically created. Alternatively, you may register without making a purchase by accessing the "My Account" menu, selecting "Register a new account", and completing the required fields.

Each product will display information regarding the estimated shipping time. This information is purely indicative and constitutes only an estimate; delays may occur for reasons beyond Atlandy's control.

Atlandy is not responsible for delivery or logistics services, which are carried out by independent courier companies. Therefore, Atlandy cannot be held responsible for any delays resulting from the actions of these entities.

Important Note: Atlandy is not liable for delays in deliveries during festive seasons, campaigns such as Black Friday, states of emergency or calamity, free shipping promotions, or other exceptional conditions that may affect the normal order processing times.

In the event of a stock shortage rendering the order incomplete, the seller will contact the customer to propose an appropriate solution.


Stock

Inventory errors may occur within Atlandy's system.

To place an order, the customer must:

  1. Access the website and select the desired items or products;
  2. Add them to the virtual shopping cart;
  3. Fill in the requested billing details and indicate the shipping address (if different);
  4. Confirm the purchase and proceed with payment.

Validation of the order implies that the customer has read and expressly accepted these General and Specific Terms and Conditions.

If the initial contact was made through social networks, email, or telephone, we may redirect the customer to the online store. In such cases, the legal framework applicable to distance contracts will always apply.

Before confirming the order, the customer may correct any technical data entry errors.

After completing the purchase, the customer will receive an automatic order confirmation email. Once payment has been made, a second email will be sent confirming the transaction and informing that the order will be dispatched to the specified address. The shipping address may be changed up until the order is dispatched.

In accordance with Decree-Law No. 7/2004, Atlandy reserves the right to unilaterally cancel any order whenever any of the following occurs:

  • programming error;
  • malfunction of computer systems;
  • distortion of the contractual proposal received;
  • product unavailable;
  • payment not made using one of the available options;
  • incorrect or unverifiable billing data;
  • impossibility of delivery to the address provided by the customer.

6. Payment Methods

Customers can make payments securely using the following methods:

  • Multibanco Reference: via ATM or internet banking. No proof of payment required.
  • Credit Card (Visa / Mastercard / Amex): processed via PayPal. 3% fee applies.
  • MB WAY: confirmation via app notification.

After purchase, the customer receives an email with payment details. Orders are dispatched only on working days. Delivery is estimated within 24 to 72 hours after dispatch.


7. Product Information

Images are illustrative. Customers should review product descriptions carefully. Technical specs are provided by sellers.

Due to supplier changes, images may differ from actual products, but specifications remain unchanged.


7.1 Product and Pricing Policy

If a product displays an incorrect price, Atlandy will notify the customer to confirm or cancel the order. Refunds are issued within 15 days. Atlandy is not obliged to honour obvious pricing errors.

Prices include VAT and are shown in the customer’s local currency. Changes do not affect confirmed orders.


7.2 Product Availability

All orders are subject to stock availability. If unavailable, Atlandy may suggest alternatives or refund the full amount.


8. Delivery and Shipping Costs

Delivery Time: Products are supplied within the timeframes indicated on the website. Exceptions may occur due to stock shortages or courier delays.


8.1 Delivery to the Specified Address

If the customer wishes their order to be delivered to a specific address, this must be selected during checkout.

Delivery is carried out by Atlandy's logistics partners and does not include scheduling. The customer must ensure someone is available to receive the order.

If the recipient is absent, a new delivery or collection may be scheduled, with any additional costs borne by the customer.


8.2 Shipping Costs

Shipping costs are the customer's responsibility and are added to the order total. These costs are communicated prior to finalising the purchase.


9. Warranties

All products sold are covered by the legal warranty regime (Decree-Law No. 67/2003, amended by No. 84/2008).

Atlandy is not responsible for damages caused by improper use or incorrect installation. The customer must confirm warranty terms with the seller.

In case of malfunction, the customer must submit a claim with invoice and complete item. Transport damage must be reported immediately with photos.

Not covered by warranty:

  • Transport costs for defective items
  • Damage from misuse or poor packaging
  • Tampering or unauthorised repairs
  • Consumables subject to wear (batteries, ink, lamps, etc.)

Any alteration to the product invalidates the warranty. Atlandy is not the manufacturer and acts only as distributor.


9.1 Warranty Conditions

Warranty is transferred from manufacturer or seller. Some products may have longer warranties; refurbished items have 1-year coverage.

For laptops, battery warranty may be limited to 1 year. Customers must follow manuals and contact sellers when in doubt.

In RMA cases, Atlandy will assist but depends on seller. Discontinued items may be replaced or credited. RMA must be requested via the customer area.

Improper RMA requests or tampered items will be returned at customer’s expense. Service fees may apply if no defect is found.

Atlandy is not responsible for data loss from repaired devices.


Advice and Tips

  • Verify product suitability before purchase
  • Research and watch demos
  • Ask sellers questions
  • Open packaging carefully and preserve contents for possible returns

10. Returns and Right of Free Contract Termination

Under Article 10 of Decree-Law No. 24/2014, customers may withdraw within 14 calendar days from:

  • Contract conclusion (services)
  • Receipt of goods (sales)

Returns must be made within 14 days. Customer bears return costs. Atlandy may withhold reimbursement until goods are received.

Inspection is allowed, but excessive use may incur liability. Refunds use the original payment method. Extra delivery costs are not refunded.

Valid return conditions:

  • Invoice presented
  • Product in perfect condition
  • Original packaging and accessories included

11. Order Cancellation

Failure to pay within two working days results in automatic cancellation.

Under Decree-Law No. 7/2004, Atlandy may cancel orders due to:

  • Programming errors
  • System malfunctions
  • Distorted proposals
  • Unavailable products
  • Invalid payment or billing data
  • Undeliverable address

Atlandy monitors compliance with quality and customer service standards but is not the direct supplier of products sold by third parties.

In the event of an issue with an order, the buyer must first contact the responsible seller through the communication channels available on the platform.


3. Returns and Right of Withdrawal

Consumers have a period of 14 calendar days to exercise their right of withdrawal, counted from the date of receipt of the product, except in legally established exceptions (personalised, perishable, or hygiene-related products, among others).

To request a return or exchange, the customer must:

  1. Log in to their Atlandy.com account.
  2. Contact the seller via the messaging system or return request form.
  3. Follow the seller's instructions for the collection or return of the product.

If the seller fails to respond or the dispute remains unresolved, Atlandy will intervene as a mediator to ensure a fair and prompt resolution.

1. Shipping Tariffs

Shipping tariffs are set by each seller based on the destination, weight, package size, and shipping method selected.

The total shipping cost will be displayed before confirming your purchase, clearly and itemised in the order summary.

Some sellers may offer free shipping or special promotions, which will be indicated directly on the product page.

Tip: Always review the specific shipping conditions on the product page or seller profile before completing your purchase.


2. Delivery Times

Delivery times may vary depending on the destination country, type of product, and shipping method selected.

Each seller will indicate the estimated preparation and delivery time in the product description.

Once your order has been dispatched, you will receive an email with a tracking number so you can monitor the delivery status in real time.

In general:

  • Domestic deliveries usually take between 2 and 5 working days;
  • International deliveries within the European Union usually take between 5 and 10 working days, except in cases of logistical delays beyond Atlandy's control.

3. International Shipping

Atlandy allows sellers to carry out shipments to Portugal and Spain.


4. Delays or Delivery Issues

If your order does not arrive within the estimated timeframe, we recommend that you:

  1. Check the delivery status using the tracking number.
  2. Contact the seller directly via your user account.
  3. If you receive no response or the issue persists, please contact Atlandy's Customer Service at suporte@atlandy.com.

5. Returns Due to Incorrect Shipping or Delivery

If you receive a product that is damaged, incomplete, or different from what you ordered, you can initiate a return request from your user account.

The seller is responsible for coordinating the collection or replacement of the product. This process may incur additional costs for the buyer, depending on the circumstances.

Atlandy supervises all return procedures to ensure a fair and prompt resolution.


6. Atlandy Logistics Programme (P.L.A.)

Sellers participating in the Atlandy Logistics Programme (P.L.A.) benefit from the support of our logistics centres and certified transport partners, enabling:

  • Proper and secure packaging;
  • Faster and safer deliveries;
  • Centralised tracking directly from your account;
  • Direct management of returns and replacements.

POLÍTICA DE DEVOLUCIONES

Returns Policy – Atlandy

At Atlandy.com, we want your shopping experience to be safe, fair and satisfactory. For this reason, we offer consumers the right to return or exchange purchased products, in accordance with the consumer protection legislation in force in Portugal and Spain.


1. Right of Withdrawal

In accordance with Directive (EU) 2011/83 on consumer rights, you have the right to withdraw from your purchase within 14 calendar days from the date of receipt of the order, without having to provide any justification.

Conditions:

  • The product must be in perfect condition, unused, and returned with its original packaging and all accessories included.
  • Returns will not be accepted for personalised, perishable, or hygiene or health products, unless they are faulty or were sent in error.
  • The buyer will be responsible for the return shipping costs, unless the item has arrived damaged, defective, or incorrect.

To exercise your right of withdrawal, simply log in to your user account and request a return through the "Return Requests" section, selecting the product and the corresponding reason.


2. Damaged, Defective or Incorrect Products

If the received product shows damage, manufacturing defects, or does not correspond to the item ordered, you may request a free return or replacement.

  • The seller is responsible for arranging the collection of the product (the seller will not be liable for return costs).
  • The refund or replacement will be processed once the item has been received and verified.
  • Atlandy monitors all return cases related to incidents to ensure a quick, fair, and compliant resolution.

3. Return Procedure

  1. Log in to your Atlandy.com account.
  2. Go to the "Return Requests" section and fill in the required fields.
  3. Select the reason for the return and, if necessary, attach photos or additional comments.
  4. The seller will receive your request and provide instructions for collection or shipment of the product.
  5. Once the item has been received, the seller will confirm the refund or dispatch of a replacement.

If the seller fails to respond within a reasonable timeframe or does not comply with the return process, Atlandy will intervene as a mediator to ensure correct application of the returns policy.


4. Refund Periods

Refunds will be made using the same payment method used for the original purchase, within a maximum of 14 calendar days from confirmation of receipt of the returned product. Processing times may vary depending on the buyer's bank or payment provider.


5. Atlandy Logistics Programme (P.L.A.)

Products managed under the Atlandy Logistics Programme (P.L.A.) benefit from a faster and more automated returns process, which includes:

  • Direct collection coordinated by Atlandy.
  • Real-time tracking of the process from your account.
  • Immediate refund once the return has been verified.

Terms and Conditions for Sellers on the Atlandy Marketplace

Legal Agreement – Superfície Conveniente, Lda.


1. Definitions

  • 1.1. Atlandy Marketplace: Online platform operated in Portugal by Superfície Conveniente, Lda., allowing third-party sellers to offer products to end consumers.
  • 1.2. Seller: Any natural or legal person registered and active on the Marketplace, agreeing to these Terms.
  • 1.3. Customer: Any person purchasing products via the Marketplace.
  • 1.4. P.L.V.: Seller Logistics Programme — Seller manages all logistics independently.
  • 1.5. P.L.A.: Atlandy Logistics Programme — Atlandy assumes full or partial logistics responsibility.
  • 1.6. Seller Plans: Bronze, Silver, Gold, Platinum — define benefits, commissions, support, and access to logistics programmes.

2. Joining the Marketplace and the P.L.V. / P.L.A. Programmes

2.1. Registration and Approval

To become a Seller, applicants must complete the online form at www.atlandy.com and already be registered as Customers.

Required documentation includes:

  • Company identification (legal name and corporate number)
  • Registered and tax address
  • Bank details for payments
  • Contact info for authorised representatives
  • Proof of legal capacity or representation

Atlandy may verify, request additional documents, and approve or reject applications without obligation to justify decisions.


2.2. Plans and Fees

Sellers choose a plan based on product volume, visibility, commissions, and services. Each plan defines:

  • Maximum number of products
  • Commission percentage + fixed transaction fee
  • Additional features (subdomain, marketing, support, logistics access)
  • Subscription price and payment frequency

Rates and terms are published at www.atlandy.com and may be updated under Section 11.


2.3. P.L.V. and P.L.A. Programmes
a) P.L.V. – Seller Logistics Programme

Included in all plans. Seller manages warehousing, preparation, dispatch, and returns independently.

b) P.L.A. – Atlandy Logistics Programme

Available only in Gold and Platinum plans. Atlandy or partners manage logistics. Sellers must comply with:

  • Packaging and labelling standards
  • Delivery deadlines to Atlandy warehouses
  • Product quality and safety requirements
  • All logistics procedures defined by Atlandy

3. Seller Obligations

The Seller undertakes at all times to comply with the following obligations when operating on the Atlandy Marketplace:


3.1. Product Quality and Compliance
  • Ensure that all products offered are safe, lawful and compliant with applicable legislation on safety, labelling, certification and EU standards.
  • Guarantee that products do not infringe any copyright, intellectual property or trademark rights of third parties.
  • Provide accurate and truthful images and descriptions, including all essential characteristics (weight, dimensions, composition, compatibility, usage instructions and safety warnings where relevant).

3.2. Order Processing and Dispatch Times

The Seller must process and dispatch orders within 48 (forty-eight) hours after order confirmation.

If the Seller fails to dispatch within this timeframe, the order may be deemed void or cancelled, and Atlandy may apply warnings, internal penalties or sanctions, without prejudice to possible account suspension or termination.

Where the Seller participates in the P.L.A. programme, the same 48-hour deadline applies for delivery of goods to Atlandy's warehouses.

Atlandy reserves the right to monitor compliance with deadlines and to impose disciplinary or contractual measures in the event of repeated breaches.


3.3. Returns, Guarantees and After-Sales Service

The Seller shall fully comply with the legal framework for returns and warranties, pursuant to the relevant EU Directives and Portuguese Decree-Laws 24/2014, 67/2003 and 84/2008 (or their successors).

In the event of a return, defective or non-conforming product, the Seller shall act promptly and cooperatively to resolve the issue according to the applicable logistics programme:

  • P.L.A.: Atlandy handles the process with the Customer and informs the Seller of the outcome and related accounting movements.
  • P.L.V.: The Seller manages the return or warranty directly, with Atlandy acting only as a moderator if necessary.

Amounts corresponding to returns, refunds or warranty claims will be debited to the Seller's account, with prior notice and detailed reporting.


3.4. Pricing, VAT and Tax Obligations
  • Set transparent final prices, inclusive of VAT and any mandatory fees or charges.
  • Issue legally compliant invoices under the applicable tax rules.
  • Meet all fiscal obligations, including VAT collection and payment.

Cross-border sales within the EU are subject to the VAT rate of Portugal (country of origin) unless otherwise provided by law.


3.5. Inventory and Availability

The Seller shall keep inventory information accurate and up to date, ensuring that only products genuinely available for sale are listed.

Publishing unavailable or discontinued products may constitute a contractual breach and lead to penalties.


3.6. Good Commercial Practices and Customer Service
  • Provide clear, courteous and efficient customer service, responding within reasonable timeframes.
  • Handle complaints and disputes promptly and constructively.
  • Adhere strictly to Atlandy's policies on shipping, delivery and returns.
  • Ensure that products delivered match the descriptions and images displayed on the Marketplace.
  • Use adequate and secure packaging to avoid damage in transit.

4. Commissions, Payments and Costs


4.1. Sales Commissions

Each sale made through the Atlandy Marketplace is subject to a percentage commission applied to the total transaction value, plus a fixed fee per operation, in accordance with the Seller Plan selected.

The applicable commission rates and fixed fees are communicated to the Seller upon registration and are also available for ongoing consultation at www.atlandy.com.

Atlandy reserves the right to update commission rates and fees, with at least fifteen (15) days' prior notice before the changes take effect.

Commissions are automatically deducted from the sale amount before any payment of the net proceeds to the Seller.


4.2. Plan Subscriptions and Maintenance

The Seller Plans (Bronze, Silver, Gold, Platinum) are subject to a monthly fee or other periodic payment as defined at the time of subscription.

Timely payment of the plan fee is an essential condition for maintaining account access and associated services.

Failure to pay within the due date may result in temporary suspension or permanent termination of the Seller's account, without prejudice to Atlandy's right to recover any outstanding amounts.


4.3. Discounts, Benefits and Penalties

Atlandy may grant discounts, commission reductions or other benefits based on objective criteria, including:

  • Volume of sales achieved
  • Compliance with dispatch and delivery deadlines
  • Customer satisfaction indicators
  • Low rate of returns or complaints
  • Participation in Atlandy marketing or quality programmes

Conversely, Atlandy may impose financial penalties, suspensions or functional restrictions if the Seller repeatedly breaches contractual obligations, particularly regarding delivery times, product quality or customer service standards.


4.4. Logistics Costs
a) P.L.V. – Seller Logistics Programme

Under the P.L.V. scheme, all logistical and operational costs associated with product preparation, packaging, shipping and returns are borne exclusively by the Seller, unless otherwise agreed in writing.


b) P.L.A. – Atlandy Logistics Programme

Under the P.L.A. scheme, the following conditions apply:

  • The Seller shall bear the shipping costs to deliver products to Atlandy warehouses
  • Storage fees shall apply, based on space, duration and volume
  • Customer delivery costs will be automatically calculated by Atlandy and charged directly to the Customer at the point of sale
  • Atlandy will deduct from the Seller's payable amounts all logistics-related charges, as per the current and pre-communicated fee schedule

5. Payments and Settlements (Financial Management)


5.1. Accounting and Seller Balance

Atlandy maintains for each Seller an individual account ledger recording all financial transactions arising from Marketplace activity, including:

  • Completed sales
  • Applicable commissions and fees
  • Logistics and service costs
  • Returns, refunds and penalties
  • Credits, adjustments or compensations where applicable

The Seller may consult their current balance at any time within their account dashboard.


5.2. Payment Cycle

Atlandy will periodically settle the amounts owed to the Seller, corresponding to confirmed and delivered sales, after deduction of commissions, fees and any applicable withholdings.

Unless otherwise specified in the Seller Plan, settlements are processed monthly, no later than the 15th day of the month following the date of sale.


5.3. Payment Methods

Payments shall be made by bank transfer to the IBAN provided by the Seller upon registration. The Seller is responsible for ensuring that bank details are accurate and up to date.

Atlandy shall not be liable for any delays or payment errors resulting from incorrect or outdated information supplied by the Seller.


5.4. Retentions and Adjustments

Atlandy may temporarily withhold part of the Seller's balance when:

  • There are pending order delivery confirmations
  • Returns, refunds or claims are under review
  • Irregularities, suspected fraud or contractual breaches are identified
  • It is necessary to offset logistical costs, penalties or accounting corrections

Such withholdings will be duly notified and reflected in the Seller's account ledger.


5.5. Returns and Negative Balances

In the event of a return or refund to a Customer, the corresponding amount will be debited from the Seller's account.

If the account shows a negative balance, the Seller must reimburse the outstanding amount within ten (10) business days following notification by Atlandy.

Failure to settle within the prescribed timeframe may result in account suspension or termination, without prejudice to Atlandy's right to recover the debt by legal means.


5.6. Reports and Transparency

Atlandy shall provide detailed financial reports to Sellers, itemising:

  • Sales totals and settlements
  • Applied commissions and fees
  • Retentions, logistics costs and adjustments
  • Payment dates and references

These reports shall have evidentiary value for accounting, fiscal and audit purposes, save for proven manifest error.

6. Atlandy's Rights


6.1. Verification, Approval and Rejection of Products

Atlandy may verify, approve or reject products that do not meet minimum quality, safety, legality, presentation, labelling or packaging requirements. Rejection may occur if:

  • Evidence of counterfeiting, illegality or rights infringement is detected
  • Product images or descriptions do not match the actual item
  • Product fails to meet safety or certification standards
  • Product may harm Atlandy's reputation, security or operational integrity

6.2. Suspension or Blocking of Accounts and Products

Atlandy may suspend or block listings, shops or accounts if:

  • Terms and Conditions are breached
  • Commercial, tax or consumer laws are violated
  • Serious or repeated customer complaints occur
  • Fraud, bad faith or unfair practices are detected
  • Commissions or fees are unpaid

Suspension may occur with or without prior notice depending on urgency or reputational risk.


6.3. Retention of Amounts and Compensation

Atlandy may retain Seller funds to:

  • Offset returns or refunds
  • Cover logistics or transport costs caused by Seller default
  • Compensate for damages to Atlandy's reputation or operations
  • Correct accounting errors or billing adjustments

All retentions will be communicated and recorded in the Seller's financial account.


6.4. Performance Monitoring and Control

Atlandy monitors Seller performance, including:

  • Order dispatch and delivery compliance
  • Return and cancellation ratios
  • Customer reviews and feedback
  • Responsiveness and support quality

Based on performance, Atlandy may:

  • Issue improvement notices
  • Apply penalties for non-compliance
  • Terminate the Seller's contract in serious or repeated breach cases

7. Atlandy's Responsibilities


7.1. Platform Availability

Atlandy shall maintain the Marketplace platform, ensuring Sellers can:

  • Publish and manage products
  • Receive and process orders
  • Manage invoicing and payments
  • Communicate with Customers and support

Maintenance or updates may occur with prior notice when possible.


7.2. Support and Assistance to Sellers

Atlandy provides support according to the Seller Plan, including:

  • Technical assistance
  • Marketing and visibility tools
  • Administrative or customer service support
  • Clear communication of policies and updates

7.3. Logistics Execution under the P.L.A. Programme

For Sellers in the P.L.A. programme, Atlandy will:

  • Receive, store and manage inventory
  • Package, dispatch and deliver orders
  • Handle returns and exchanges
  • Communicate operational status and stock movements

Atlandy is not liable for Seller errors affecting logistics (e.g. incorrect labelling or non-compliant products).


7.4. Transparency and Communication

Atlandy ensures transparency regarding:

  • Fees, commissions and logistics costs
  • Return and warranty policies
  • Contract terms and updates
  • Performance criteria and rule changes

Information is shared via the Seller dashboard or electronic communication.


8. Intellectual Property


8.1. Seller Content
  • The Seller declares ownership or authorisation to use all content published on the Marketplace (trademarks, logos, images, descriptions, etc.).
  • Content must not infringe third-party rights.
  • The Seller assumes full responsibility for any infringement.
  • Seller grants Atlandy a non-exclusive, royalty-free, worldwide, sublicensable licence to use content for promotional and operational purposes while the account is active.

8.2. Atlandy's Content and Property

All elements of the Marketplace (design, software, database, interface, logos, etc.) are the exclusive property of Superfície Conveniente, Lda. or its licensors.

Reproduction, distribution or modification without prior written consent is strictly prohibited.


8.3. Content Oversight and Removal

Atlandy may remove or reject any content that:

  • Infringes intellectual property rights
  • Is false, misleading, unlawful or offensive
  • May harm the Marketplace's image or operations

Atlandy may cooperate with authorities in case of suspected violations.


9. Data Protection


9.1. Legal Compliance

Atlandy processes personal data in accordance with GDPR, Portuguese law and EU regulations for account management, transactions, support and legal compliance.


9.2. Responsibility for Data Processing

Atlandy acts as Data Controller for platform data. Sellers act as Independent Controllers for Customer data and must comply with GDPR and applicable laws.


9.3. Data Subject Rights

Data subjects may exercise rights of access, rectification, erasure, restriction, portability and objection by contacting Atlandy via the email in the Privacy Policy.

Sellers authorise Atlandy to use their contact details for account and contractual communications.

10. Term, Suspension and Termination


10.1. Commencement and Duration

This Agreement begins upon Seller registration approval and remains valid indefinitely while the account is active and compliant.


10.2. Termination by the Seller

The Seller may terminate with 30 days’ written notice. Obligations remain for:

  • Outstanding payments
  • Proportional plan fees
  • Confirmed orders still pending

Atlandy will deactivate the account and retain data required by law.


10.3. Suspension or Termination by Atlandy

Atlandy may suspend or terminate the Agreement if:

  • Terms are seriously or repeatedly breached
  • Fraud or unlawful conduct occurs
  • False information is provided
  • Deadlines, quality or tax obligations are not met
  • Reputational or operational risk is proven
  • Account remains inactive per internal policy

In urgent cases, suspension may occur immediately without prior notice.


10.4. Consequences of Termination
  • Outstanding balances will be settled
  • Access to account and tools will be revoked
  • Minimal data may be retained for legal purposes
  • No indemnity or compensation unless legally required

11. Amendments to the Terms and Conditions


11.1. Right to Amend

Atlandy reserves the right to amend, update or supplement these Terms and Conditions, as well as its internal policies, commission tables, Seller Plans and platform features, at any time.


11.2. Notice and Effective Date

Any amendment shall be notified to the Seller in advance, by email and/or through the Seller's dashboard, at least fifteen (15) days before it becomes effective.

During this period, the Seller may review the changes and, if they do not agree, may terminate the Agreement in accordance with Section 10 without penalty.

Continued use of the platform after the notice period shall constitute tacit acceptance of the amended Terms.


11.3. Publication and Access

The latest version of these Terms and Conditions shall always be available at www.atlandy.com. It is the Seller's responsibility to stay informed of updates and policy changes.


12. Limitation of Liability and Disclaimer of Warranties


12.1. Exclusion of Liability

Atlandy shall not be liable for:

  • Technical failures, interruptions or unavailability of the platform
  • Acts, omissions or defaults of Sellers, Customers or third parties
  • Financial losses, indirect or consequential damages, loss of profit or data
  • Illegal, defective or non-conforming products listed by Sellers
  • Delays or failures caused by external service providers, including carriers and payment institutions

12.2. Limited Warranties

The Atlandy Marketplace is provided on an "as is" basis, without express or implied warranties as to availability, continuity, performance or fitness for a particular purpose.

Nothing in these Terms shall exclude or limit Atlandy's liability where such exclusion or limitation is prohibited by law, including cases of fraud or gross negligence.


13. Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with Portuguese law.

Any dispute shall fall within the exclusive jurisdiction of the Courts of the District of Aveiro (Portugal), with express waiver of any other jurisdiction, except where mandatory law provides otherwise.

Parties may also resolve disputes through alternative dispute resolution (ADR), including Consumer Arbitration Centres or the European Online Dispute Resolution (ODR) Platform: https://ec.europa.eu/consumers/odr


14. Communications and Notices

All communications between Atlandy and the Seller shall be made electronically via the platform or registered email addresses and shall be deemed valid and legally effective.

Atlandy may send informational, administrative, commercial or contractual communications related to Marketplace operations, which shall be considered an integral part of the contractual relationship.


15. Acceptance and Entire Agreement

By completing registration and clicking "I Accept the Terms and Conditions", the Seller declares that they have read, understood and accepted this Agreement in full, and undertakes to comply with all its provisions.

The nullity or invalidity of any clause shall not affect the validity of the remaining provisions.

This document constitutes the entire agreement between the parties, superseding any prior understanding, correspondence or communication relating to its subject matter.

Product and Warehouse Reception Policy – Atlandy


1. Purpose

This Policy establishes the rules applicable to the preparation, dispatch, reception and storage of products offered by sellers on the Atlandy Marketplace, as well as the conditions for their acceptance or rejection within the logistics programmes P.L.V. (Seller Logistics Programme) and P.L.A. (Atlandy Logistics Programme).


2. Authorised Products

Only products that meet the following conditions may be marketed and sent to Atlandy warehouses:

  • Comply with the legislation in force in Portugal, Spain and the European Union
  • Are properly labelled with the manufacturer's, importer's or distributor's information, in Portuguese or Spanish, according to the destination country
  • Are new, original and in perfect condition, showing no signs of use
  • Possess the certificates or permits required for their category (e.g. CE marking, INCI, MSDS, health or electrical certifications)
  • Do not infringe any intellectual property or trademark rights

3. Prohibited or Restricted Products

Products will not be accepted if they:

  • Are illegal, counterfeit, stolen or pirated
  • Contain hazardous, explosive or flammable substances without prior authorisation
  • Are considered sensitive material (weapons, medicines, tobacco, animals, adult content, etc.)
  • Have expiry dates shorter than six months or lack clear traceability
  • Are poorly packaged, dirty or incomplete
  • Do not include the documentation requested by Atlandy or by the competent authorities

4. Preparation and Dispatch of Products

Sellers must:

  • Label each unit with a unique identification code (EAN) provided by the platform
  • Include with each shipment a packing list detailing units, weights and references
  • Use strong, sealed packaging without logos unrelated to the product
  • Group the products into boxes or pallets according to Atlandy's logistics instructions
  • Dispatch the products only after confirmation of a logistics appointment (reception booking)

5. Warehouse Reception

At the time of reception:

  • Atlandy staff shall verify the integrity, quantity and conformity of the shipment

Products that do not meet the requirements may be rejected or returned to the sender, who shall bear the associated costs.

Accepted products shall become available for sale on the platform.

Any discrepancy or damage detected will be reported to the seller within a maximum period of 48 hours.


6. Seller's Responsibility

The seller is responsible for:

  • The accuracy of the product information published on the platform
  • The correct preparation and dispatch of products to the warehouse
  • The costs associated with the return or removal of rejected products or those withdrawn from inventory
  • Complying at all times with Atlandy's policies on acceptable use, intellectual property, and consumer protection

7. Modifications and Updates

Atlandy may update this Policy at any time, notifying sellers of any changes at least 15 days in advance, through the seller panel or by email.

Continued use of the logistics services shall constitute acceptance of the new conditions.
